Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Novus Sports LLC ("Novus," "we," "our," or "us"), a New Jersey limited liability company. These Terms govern your access to and use of the Novus Basketball platform, including our website, mobile application, video content library, AI-generated workout tools, and all associated services (collectively, the "Platform").

By creating an account, submitting payment, or otherwise accessing the Platform, you represent that you are at least 13 years of age (or that a parent or legal guardian has consented on your behalf) and have the legal capacity to enter into this agreement.

2. Account Registration

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not share your account credentials with others. Each subscription is for the individual account holder. Unauthorized sharing of account access is a material violation of these Terms and may result in immediate termination.

3. Subscriptions and Billing

3.1 Subscription Plans

Novus Basketball offers subscription-based access to the Platform. Plan options, pricing, and included features are described on our website and are subject to change with notice. Current plans include:

• Basic Plan — individual access to the drill video library and standard workout generation
• Pro Plan — expanded features including personalized AI workout scheduling
• Hall of Fame Plan — full access to all current and future Platform features

3.2 Payment

Payment is due at the start of each billing cycle. We accept major credit and debit cards processed securely through Stripe. You authorize us to charge your payment method for all applicable fees. All fees are in U.S. Dollars and are non-refundable except as explicitly stated herein or required by applicable law.

3.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle.

4. Intellectual Property

All content on the Platform — including but not limited to drill instructional videos, training protocols, workout programs, written materials, graphics, logos, and software — is owned by or licensed to Novus Sports LLC and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform content solely for your personal, non-commercial training and development purposes. This license does not permit you to:

• Download, copy, reproduce, or redistribute any video content or training materials
• Screen-record, screenshot, or capture Platform content for sharing
• Re-sell, sublicense, or otherwise commercialize any portion of the Platform
• Use our name, trademarks, or branding without prior written consent

Unauthorized use of our intellectual property may result in immediate account termination and legal action.

5. Prohibited Conduct

You agree not to:

• Violate any applicable local, state, national, or international laws or regulations
• Share, sell, or transfer your account credentials to any third party
• Attempt to gain unauthorized access to any portion of the Platform or its systems
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform to transmit any unsolicited communications or harmful code
• Post or upload any content that is defamatory, obscene, or infringes upon third-party rights
• Use automated tools, bots, or scrapers to access or extract content from the Platform

6. User-Generated Content

If you submit feedback, performance data, testimonials, or other content through the Platform, you retain ownership of that content but grant Novus Sports LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating and promoting the Platform. We will not identify you by name in any marketing use without your consent.

7. Disclaimer of Warranties

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Basketball training involves inherent physical risk; we are not responsible for any injuries sustained while following content or programs delivered through the Platform. Consult a qualified physician before beginning any new physical training regimen.

8. Limitation of Liability

In no event shall our total aggregate liability to you exceed the greater of (a) the total fees paid by you in the twelve months preceding the claim or (b) one hundred dollars ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Novus Sports LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for violation of these Terms or for any conduct we determine, in our sole discretion, to be harmful to the Platform, our users, or our business. Upon termination, your license to access the Platform ceases immediately.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law.

11. Modifications to Terms

We may update these Terms at any time. When we do, we will revise the Effective Date at the top of this page and, for material changes, notify you via email or a prominent notice on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use and may cancel your subscription.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.

13. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision does not constitute a waiver. These Terms constitute the entire agreement between you and Novus Sports LLC regarding the Platform and supersede all prior agreements.
